Copyright in all design, drawings, models/
prototypes and specifications, and in the work
executed from them will remain the property of
the Designer unless otherwise agreed.
1. Original one of a kind artworks are
neither returnable nor refundable.
4.4.2 The original design, drawings, models/
prototypes and specifications remain the property
of the Designer. They may not be used for any
other purpose than that for which they were
originally commissioned.
4 4.3 The Client shall be permitted to retain
copies of design, drawings and specifications
for information but these shall not be used by
the Client as a basis for modification to the
original design, on other projects, for additional
works to the original project, or for completion
of the original Commission by others, except
by agreement in writing and with appropriate
compensation to the Designer.
4.4.4 Payment of the fee for a design does not
entitle the Client to have the project executed
without the co-operation and permission of the
Designer.



In the normal course of the Commission the
Designer will:
i Design Development Stage: Accept/prepare
Client brief, develop design concepts, prepare
sketch design(s) - with or without estimate of
cost.
ii Detail Design and Documentation Stage:
Detail the selected concepts, prepare necessary
documentation for tenders, prepare an
assessment of the cost and anticipated time
programme.
iii Contract Supervision and Administration
Stage: Liaise with the Client, evaluate tenders,
prepare necessary contract documents, commit
production, supervise and inspect the work to
completion.
3.3.1 This enumeration is not exhaustive, but
serves to indicate the principal constituent of the
work the Client may expect from the Designer.
It also serves to identify parts of the work the
Designer may not be required to perform. The
Designer is advised to obtain the written consent
of the Client before starting.
3.4 Scope of the Commission
In the course of the Design Commission the need
for work going beyond the scope of the ‘normal
course of the Commission’ may occur, and the
Designer should inform the Client that this work
should be separately remunerated.
3.4.1 The following items of work are generally
agreed to be outside the scope of the ‘normal
course of the Commission’:
a) Preparing a report/feasibility study
b) Initiating/undertaking research to augment a
Client brief
c) Undertaking a work study programme
d) Controlling/co-ordinating professional services
falling outside the scope of the ‘normal course


3.4 Scope of the Commission
In the course of the Design Commission the need
for work going beyond the scope of the ‘normal
course of the Commission’ may occur, and the
Designer should inform the Client that this work
should be separately remunerated.
3.4.1 The following items of work are generally
agreed to be outside the scope of the ‘normal
course of the Commission’:
a) Preparing a report/feasibility study
b) Initiating/undertaking research to augment a
Client brief
c) Undertaking a work study programme
d) Controlling/co-ordinating professional services
falling outside the scope of the ‘normal course
of the Commission’ as defined under section
3.3.
e) Giving out information to outsiders concerning
the project if the Client so requires.
